EBSA releases its semiannual regulatory agenda

The Employee Benefits Security Administration (EBSA) has released its semiannual regulatory agenda, which outlines regulations that have been selected for review or development during the next year, as well as any regulations that have been finalized during the last six months.

Proposed rules

Items in the proposed rule stage are actions for which EBSA intends to publish a notice of proposed rulemaking (NPRM) or for which the closing date for an NPRM is the next step. These proposed rules include those governing:

• The definition of plan assets

• ERISA Sec. 404(c) rules on the disclosure of fees and expenses to plan participants

Final rules

Items in the final rule stage are actions for which EBSA plans to publish a final or interim rule as the next step in the rulemaking process. Final rules generally affecting both pension and welfare plans include:

• Revision of the Form 5500 Series and regulations to conform to electronic filing of annual reports requirement

• Default investment alternatives under participant-directed individual account plans

Completed actions

The regulatory actions recently completed by EBSA include:

• Rules on the termination of abandoned individual account plans

• Amendment of the Voluntary Fiduciary Correction Program

• Regulations under ERISA §104(a) requiring electronic filing of annual reports
