No PPA technical corrections until 2007, ASPPA chief says

A technical corrections bill for the Pension Protection Act of 2006 (PPA; P.L. 109-280) probably will be passed as part of a tax bill in the first six months of 2007, rather than in a "lame duck" session of Congress in 2006, according to Brian Graff, executive director of the American Society of Pension Professionals and Actuaries (ASPPA). He explained that there is no sense of urgency because the bill will be "hyper-technical"—correcting inaccurate cross references, grammar, and spelling. Graff made his remarks at a press conference at the 2006 ASPPA annual conference in Washington, D.C. on October 24, 2006.

The staff of the Joint Committee on Taxation is currently collecting items for inclusion in a technical corrections bill. No clarifications or reworkings of PPA provisions will be done, Mr. Graff explained, because of the political ramifications involved with any changes in the law. Instead, he expects the government agencies charged with interpreting the law will attempt to work around the contentious issues on a regulatory basis. For example, he predicts that the Department of Labor will resolve by regulations which entity must charge level fees for giving investment advice to retirement plan participants: the individual fiduciary adviser, the fiduciary adviser's employer, or someone else. Congress is not interested in such details, he concluded.
