CCH® UNEMPLOYMENT INSURANCE — 4/24/14

Teacher who failed to obtain Master’s degree as required left his job without good cause

The claimant, a teacher, failed to obtain a Master’s degree in education, as required in order to be properly certified and maintain his employment. The employer terminated the claimant’s employment due to a lack of a valid teaching certificate and the claimant’s application for benefits was denied because he was considered to have voluntarily left his employment without good cause. Because the claimant had sufficient time to obtain the Master’s degree prior to the deadline set by the employer, he failed to take reasonable steps to protect his continued employment. The denial of benefits was affirmed (In re Peter H. Duncanson, N.Y. Sup. Ct., App. Div., No. 01802, March 20, 2014.).
