EBSA extends annual reports deadline in ten states affected by natural disasters

The Employee Benefits Security Administration (EBSA) of the U. S. Department of Labor has announced an extension of the deadline for filing the Form 5500 and Form 5500-EZ annual report/return in ten states which have been affected by severe storms, tornadoes and flooding. The extension applies to plan administrators, employers and other entities located in the presidential disaster areas directly affected, as identified by the Federal Emergency Management Agency. The extension also applies to firms located outside the affected areas that are unable to obtain the necessary information from service providers, banks or insurance companies whose operations were directly affected by the weather. The states are affected as follows:

For Arkansas entities, Form 5500 series filings required to be filed between May 2, 2008, and July 21, 2008, are granted an extension until July 21, 2008.

For Colorado entities, Form 5500 series filings required to be filed between May 22, 2008, and July 25, 2008, are granted an extension until July 25, 2008.

For Georgia entities, Form 5500 series filings required to be filed between May 11, 2008, and July 22, 2008, are granted an extension until July 22, 2008.

For Indiana entities, Form 5500 series filings required to be filed between May 30, 2008, and August 7, 2008, are granted an extension until August 7, 2008.

For Iowa entities, Form 5500 series filings required to be filed between May 25, 2008, and July 28, 2008, are granted an extension until July 28, 2008.

For Maine entities, Form 5500 series filings required to be filed between April 28, 2008, and July 8, 2008, are granted an extension until July 8, 2008.

For Mississippi entities, Form 5500 series filings required to be filed between April 4, 2008, and July 28, 2008, are granted an extension until July 28, 2008.

For Missouri entities, Form 5500 series filings required to be filed between May 10, 2008, and July 22, 2008, are granted an extension until July 22, 2008.

For Oklahoma entities, Form 5500 series filings required to be filed between May 10, 2008, and July 14, 2008, are granted an extension until July 14, 2008.

For Wisconsin entities, Form 5500 series filings required to be filed between June 5, 2008, and August 13, 2008, are granted an extension until August 13, 2008.

Plan filers entitled to an extension of relief should check Part I, Box D on the Form 5500 or Part I on Form 5500-EZ, and attach a statement to the form in accordance with the instructions. Filers who have additional questions may contact EBSA’s EFAST Help-line toll-free at 866-463-3278.
