PBGC issues disaster relief for Indiana, Wisconsin, West Virginia, Nebraska, Illinois, and Missouri

The Pension Benefit Guaranty Corporation (PBGC) has announced relief from certain deadlines and penalties in connection with the Form 5500 series for “designated persons” in certain areas declared disaster areas due to severe weather conditions.

The affected areas are:

The following counties in Indiana: Adams, Bartholomew, Brown, Clay, Daviess, Dearborn, Decatur, Gibson, Grant, Greene, Hamilton, Hancock, Hendricks, Henry, Huntington, Jackson, Jefferson, Jennings, Johnson, Knox, Lawrence, Madison, Marion, Monroe, Morgan, Owen, Parke, Pike, Posey, Putnam, Randolph, Ripley, Rush, Shelby, Sullivan, Tippecanoe, Vermillion, Vigo, Washington and Wayne counties, affected by severe storms, flooding, and tornadoes occurring on May 30, 2008.

The following counties in Wisconsin: Adams, Calumet, Crawford, Columbia, Dane, Dodge, Fond du Lac, Grant, Green, Green Lake, Iowa, Jefferson, Juneau, Kenosha, La Crosse, Manitowoc, Marquette, Milwaukee, Monroe, Ozaukee, Racine, Richland, Rock, Sauk, Sheboygan, Vernon, Walworth, Washington, Waukesha and Winnebago counties, affected by severe storms, flooding, and tornadoes occurring on June 5, 2008.

The following counties in West Virginia: Barbour, Clay, Doddridge, Gilmer, Harrison, Jackson, Jefferson, Marion, Taylor, Tucker, Tyler and Wetzel counties, affected by severe storms, tornadoes, mudslides, landslides, and flooding occurring June 3, 2008.

The following counties in Nebraska: Buffalo, Butler, Colfax, Custer, Dawson, Douglas, Gage, Hamilton, Jefferson, Kearney, Lancaster, Platte, Richardson, Sarpy and Saunders counties, affected by severe storms, tornadoes, and flooding occurring May 22, 2008.

The following counties in Illinois: Adams, Calhoun, Clark, Coles, Crawford, Cumberland, Douglas, Edgar, Hancock, Henderson, Jasper, Jersey, Lake, Lawrence, Mercer, Rock Island, Whiteside and Winnebago counties, affected by severe storms and flooding occurring June 1, 2008.

The following counties in Missouri: Clark, Gentry, Lewis, Lincoln, Linn, Livingston, Marion, Pike, Ralls and St. Char-lies counties, affected by severe storms and flooding occurring June 1, 2008.

The relief granted generally extends through August 29, 2008. “Designated persons” are those who are either located in the disaster area or those who cannot reasonably obtain information or other assistance needed to meet the deadline because a service provider, bank, or other entity was directly affected by the natural disaster.
