IRS clarifies when Form 5558 requires signature

The IRS has clarified when Form 5558 (Application for Extension of Time To File Certain Employee Plan Returns) requires a signature. If Form 5558 is used to file an extension for Form 5500 (Annual Return/ Report of Employee Benefit Plan) or Form 5500-EZ (Annual Return of One-Participant (Owners and Their Spouses) Retirement Plan) a signature is not required. The checkbox concerning a Form 5500 series extension is located in Box 1a of Form 5558.

A signature is required if the extension request concerns the filing of Form 5330 (Return of Excise Taxes Related to Employee Benefit Plans). The checkbox concerning a Form 5330 series extension is located in Box 1b of Form 5558.

The IRS plans to revise Form 5558 by Fall 2006 to better reflect this practice.
