IRS issues 2010 schedule of employee plan user fees

The IRS has updated its user fee schedule in IRS Revenue Procedure. 2010-8, effective January 4, 2010, for requests for various types of employee plan letter rulings and determination letters, and other matters under the jurisdiction of the Commissioner, Tax Exempt and Government Entities Division.

According to the IRS, some changes have been made to the fee schedule in Section 6. With respect to letter ruling request user fees, a specific category for "Five-Year Automatic Extension of the Amortization Period" is added and the user fee is changed to $1,000. Various employee plan and exempt organization user fees are also updated. An additional change to the schedule of user fees for advisory letters on volume submitter plans include a new category for "Assumption of sponsorship of an approved volume submitter plan, without any amendment to the plan document, by a new entity, as evidenced by a change of employer identification number, per basic plan document." With respect to user fees for determination letters, Form 5316 is being developed and will be available soon for group trust submissions. A new mailing address is provided for the submission of pre-approved employee plans by Express Mail or delivery service. Finally, Schedule D of the Appendix is updated to reflect Rev. Proc. 2009-9, which contains revised procedures with regard to applications from organizations for exemption from federal income tax under Code Sec. 501 and Code Sec. 521.
