Due dates for Oklahoma withholding have been changed. Every employer required to deduct and withhold taxes must remit the taxes to, and file a quarterly return with, the Oklahoma Tax Commission (OTC) on or before the 20th day of the month following the close of each calendar quarter. Previously, due dates depended on the amount of withholding owed to the OTC. Also, every employer required to remit federal withholding under the federal Semiweekly Deposit Schedule must pay over the amount of Oklahoma income tax withheld on the same dates as required under the federal Semiweekly Deposit Schedule for federal withholding taxes (previously, on or before the 20th day of the month following the close of the calendar quarter).
If an employer fails to file a return or to pay to the OTC the withholding tax within the required time, a penalty is imposed equal to 10% of the amount of tax, or 10% of the amount of the underpayment of tax, if such failure is not corrected within 15 days after the tax becomes delinquent (previously, on or before the last day of the month when due). The change also applies to amounts withheld from oil and gas royalties and amounts required to be withheld by pass-through entities. (Ch. 365 (H.B. 2576), Laws 2012, effective July 1, 2012.)
