Oklahoma bans local government minimum wage, sick leave requirements

Oklahoma Gov. Mary Fallon signed legislation on April 14 to prohibit municipalities and other political subdivisions from establishing a mandatory minimum number of vacation or sick leave days, whether paid or unpaid, or a minimum wage rate that an employer would be required to pay employees. The legislation, S.B. 1023, makes any such existing and future ordinances, orders or regulations null and void.

The measure does not affect the minimum number of vacation or sick leave days authorized by a municipality for its own employees as a benefit of employment. S.B. 1023 would not affect any exemption from state statutes previously allowed for certain municipalities pursuant to Section 1-101 of Title 11 of the Oklahoma Statutes (Oklahoma Municipal Code).
