Michigan: FUTA credit; clarification

We recently reported that all 50 states had received 12-month certifications under the FUTA for the maximum additional credit allowable, which would permit their employers to pay FUTA taxes at the net rate of 0.8% for the 2009 tax year. However, although all 50 states did receive the certifications (74 Fed. Reg. 57200, November 4, 2009), the State of Michigan was unable to pay back its outstanding federal loans within the allotted two-year time frame. As a result, Michigan employers will not receive the full tax credit and thus will have a FUTA tax rate of 1.1% for the 2009 tax year (see, also, the story in UI Report 768, dated October 12, 2009 UI-REPORT-LETTER No. 768). We apologize for any confusion that may have resulted.

DOL issues final H-2A temporary agricultural worker rule

In a move closely watched by the agricultural industry, labor and immigrant rights groups, the Department of Labor (DOL) has released a final rule reversing changes made by the Bush administration to the labor certification process and enforcement mechanisms governing the H-2A temporary agricultural worker program. The major change included in the DOL's final rule is the switch from the attestation-based system created by the Bush administration's final rule back to the Adverse Effect Wage Rate (AEWR), which is the minimum wage rate that must be offered and paid to H-2A agricultural workers. The rule takes effect March 15, 2010. (75 FR 6883, February 12, 2010.)

California FTB offers webinar on nonresident withholding changes

The California Franchise Tax Board (FTB) will be offering a series of California source income withholding webinars throughout 2010. One webinar will cover the 2010 resident and nonresident personal income tax withholding changes. This webinar will be held on Wednesday, March 10, 2010, from 10:00 a.m. to 11:00 a.m. P.S.T. and will highlight the 2010 processing, legislative, and form changes for resident and nonresident withholding.

SSA launches new Open Government webpage

Michael J. Astrue, Commissioner of Social Security, recently announced that the agency has a new Open Government webpage available to the public at www.socialsecurity.gov/open. The new webpage serves as the portal for all agency activities that support the President's Transparency and Open Government initiative.

"Our new Open Government webpage gives Americans an opportunity to give us their ideas on how we can become a more open and transparent agency," Commissioner Astrue said. "They will be able to post their ideas on transparency, participation, collaboration, and innovation that should be included in our Open Government Plan. I encourage everyone to visit our webpage and submit their ideas, read and discuss what has been posted, and vote on the ideas that have been submitted."

To submit ideas, click on the link at the top right of the webpage that says, "Share your ideas on our open government plan." After agreeing to the terms of participation, the link will take you to a webpage that asks for ideas on how Social Security can:

The SSA's new Open Government webpage also provides easy access to important agency information such as the Agency Strategic Plan, Freedom of Information Act Report, as well as program laws and regulations. In addition, the webpage includes links to the datasets that were published last month on www.Data.gov. The agency will publish its Open Government Plan in April (SSA Press Release, February 10, 2010).
