On October 6, 2008 (73 FR 58352–58385), EPA proposed national emission standards for nine categories of area sources in the chemical manufacturing sector that would affect 450 existing facilities.

Performance Specifications for Continuous Parameter Monitoring Systems Proposed

EPA proposed performance specifications and quality assurance procedures for continuous parameter monitoring systems (CPMS) at stationary sources on October 9, 2008 (73 FR 59956–60005).

Appeals Court Affirms Use of Uncertainty Factor to Calculate Future Superfund Cleanup Costs

In a July 28, 2008 decision, the U.S. Court of Appeals for the Third Circuit ruled that a district court could enter a monetary judgment against a liable party in a Superfund contribution action based on the expected costs for future cleanup of the contaminated site (Action Manufacturing Co. v. Simon Wrecking Co., No. 06-3679 [3d Cir. July 28, 2008]).

New Multi-Sector General Permit Issued for Storm Water Discharges From Industrial Activity

In a September 29, 2008 notice (73 FR 56572–56578), EPA announced the issuance of a new multi-sector general permit covering storm water discharges from industrial activities that will be available in EPA Regions 1, 2, 3, 5, 6, 9, and 10.
