Appeals Court Affirms Use of Uncertainty Factor to Calculate Future Superfund Cleanup CostsIn a July 28, 2008 decision, the U.S. Court of Appeals for the Third Circuit ruled that a district court could enter a monetary judgment against a liable party in a Superfund contribution action based on the expected costs for future cleanup of the contaminated site (Action Manufacturing Co. v.
