Notice of Violation and Enforcement Action Does Not Trigger Duty to Object to Title V Permit

In a September 2, 2008 decision, the U.S. Court of Appeals for the Eleventh Circuit held that issuing a notice of violation and initiating an enforcement action do not obligate EPA to object to a CAA Title V operating permit (Sierra Club v. EPA, No. 07-11537 [11th Cir. Sept. 2, 2008]).

EPA Announces Approval Program for Lead-Based Paint Test Kits

In September 2008, EPA announced the start of its two-phase approval process for lead test kits in support of the agency’s lead-safe practices for renovation, repair, and painting activities.

Final Rule Establishes Incentive for States to Collect NPDES Permit Fees

In a September 10, 2008 final rule (73 FR 52584–52591), EPA revised the agency’s allotment formula for distributing Clean Water Act Section 106 funds to encourage states to collect fees to cover National Pollutant Discharge Elimination System program costs.
