PM-2.5 Increments, Significant Impact Levels, and Significant Monitoring Concentrations Proposed

EPA has proposed PM-2-5 (particulate matter with an aerodynamic diameter less than or equal 2.5 microns) increments, significant impact levels, and significant monitoring concentrations for areas currently attaining the PM-2.5 national ambient air quality standards (NAAQS). These values are important screening tools used to determine the level of analysis required for new major sources and modifications subject to prevention of significant deterioration (PSD) permitting requirements.

Widely Applicable Emission Standards Proposed for Surface Coating and Paint Stripping Operations

EPA’s proposed emission control requirements for surface coating and paint stripping operations are expected to apply to 39,000 facilities. Under the proposed generally available control technology (GACT) standards, owners/operators of miscellaneous surface coating and methylene chloride paint stripping operations at area sources would be required to comply with equipment specifications and management practices to reduce hazardous air pollutant (HAP) emissions.

Trustee May Seek Damage Assessment Costs Before Selection of Remedial Action Plan

The United States District Court for the Eastern District of Washington has ruled that a natural resource trustee can seek reimbursement of site assessment costs before a Superfund site's remedial action plan is selected (Confederated Tribes and Bands of the Yakama Nation v. United States, No. CY-02-3105-LRS [E.D. Wash., Sept. 4, 2007]). The case addresses the release of radionuclides and other hazardous substances at the Hanford Nuclear Reservation (Hanford) in Washington.

Lead and Copper Rule Revised

EPA has finalized revisions to the national primary drinking water regulations for lead and copper. The final rule implements changes to seven aspects of the lead and copper rule, but does not amend the portion of the regulations dealing with copper, which may be addressed in future rulemakings.

Climate Risk Disclosure: Who Stands to Benefit?

On September 18, 2007, a group of investors, consisting of Ceres, the California Public Employees' Retirement System (CALPERS), F&C Asset Management, and the New York City Comptroller, forwarded a petition to the US Securities and Exchange Commission (SEC) asking for additional disclosure of "climate risk" in listed companies' earnings and operational statements. Where does one set the limits to arrive at practical values?

CLIMATE CHANGE

Lieberman-Warner Climate Bill Hits the Senate

A Virginia Republican John Warner and Connecticut Independent Democrat Joe Lieberman introduced a bill to cap US greenhouse gas (GHG) emissions by 2012, then cut them 10% by 2020 (to 1990 levels) and 70% by 2050. The bill creates a market for emission allowances.
