ENVIRONMENTAL COMPLIANCE

New Ambient Air Quality Standards for Ozone Proposed

On July 11, 2007 (72 FR 37818-37919), EPA proposed to revise the national ambient air quality standards (NAAQS) for ozone to provide better protection of public health and welfare. Under the proposed rule, the primary ozone NAAQS would be revised to a level within the range of 0.070 to 0.075 ppm to provide increased protection for children and other at-risk populations against a variety of ozone-related health effects. EPA has also proposed to revise the secondary NAAQS for ozone to 7–21 ppm-hours, or to be identical to the proposed primary standard.

Reactivity-Based VOC Standard Proposed for Aerosol Coatings

On July 16, 2007 (72 FR 38952-38991), EPA proposed new national emission standards that would regulate volatile organic compound (VOC) emissions from aerosol coatings based on the reactivity of the coating constituents. The proposed rule would establish reactivity limits expressed in terms of grams of ozone generation per gram of coating, and would take into account the ozone generation potential of the various components of a given product.

Chat Use Subject to New Regulations

On July 18, 2007 (72 FR 39331-39353), EPA issued a rule that finalizes requirements for the use of chat in transportation projects that are paid for, in whole or in part, with federal funds. The chat covered by this rule is from the lead and zinc mining areas of Oklahoma, Kansas, and Missouri, which is known as the Tri-State Mining District.

Site-Specific Risk Assessments for Hazardous Waste Combustors Upheld

The Cement Kiln Recycling Coalition (Coalition) is a trade association that includes manufacturers of Portland cement, and some of these facilities use hazardous waste as an alternative fuel in some kilns. In a July 13, 2007 decision, the U.S. Court of Appeals for the District of Columbia Circuit (DC Circuit Court) denied a petition brought by the Coalition to review the RCRA regulations that govern the permitting process for facilities that burn hazardous waste as fuel (Cement Kiln Recycling Coalition v. EPA, No. 06-1005, [D.C. Cir. July 13, 2007]).
