State Required to Join Suit Under CWA Section 309(e) Waived Sovereign ImmunityIn an August 3, 2009 decision, the U.S. Court of Appeals for the Eighth Circuit upheld a lower court’s decision that Missouri waived sovereign immunity by filing a CWA enforcement action alongside the United States in federal district court [(United States v.
