CCH® Environmental NetNews™ ENVIRONMENTAL COMPLIANCEAppeals Court Rules CO2 Emission Reductions Can Be Sought Under Public Nuisance Common LawIn a September 21, 2009 decision, the U.S. Court of Appeals for the Second Circuit ruled that the six power companies involved in the case could be sued under the federal common law of public nuisance based on the assertion that carbon dioxide emissions from their power plants contribute to global warming (Connecticut v. American Electric Power, No. 05-5104-cv [2nd Cir. Sept. 21, 2009]). Motor Vehicle Fuel Economy and Greenhouse Gas Emission Standards ProposedOn September 28, 2009 (74 FR 49454–49789), EPA and the National Highway Traffic Safety Administration (NHTSA) issued a joint proposal to establish motor vehicle fuel economy and greenhouse gas emission standards that will cover passenger cars, light-duty trucks, and medium-duty passenger vehicles built in model years 2012 through 2016. EPA Announces Efforts to Strengthen Chemical Management Under TSCAIn September 2009, EPA issued a document entitled “Essential Principles for Reform of Chemicals Management Legislation,” which is designed to provide information on the agency’s position on how to strengthen the Toxic Substances Control Act (TSCA) as Congress works to reauthorize the legislation. Extension of Construction Industry General Storm Water Permit ProposedOn October 19, 2009 (74 FR 53494–53498), EPA proposed to modify the 2008 National Pollutant Discharge Elimination System (NPDES) general permit for storm water discharges associated with construction activity, which applies to new dischargers engaged in large and small construction activities that are located in areas where EPA is the NPDES permitting authority, except those located in EPA Region 4. SUSTAINABLE DEVELOPMENTSustainability Software on the HorizonAccording to a recent report from Ovum, as more companies add “sustainability” to their goals, and as standards and requirements become more universal, companies are increasingly looking at sustainability software as a way to save money, with the expectation that regulations aimed at green supply chain management will become the norm. CLIMATE CHANGEInnovations for Greenhouse Gas ReductionsThe International Council of Chemical Associations recently reported the findings of a life cycle quantification of carbon abatement solutions enabled by the chemical industry, which found that, for every unit of greenhouse gases emitted directly and indirectly by the chemical industry, the industry enabled more than two units of emission savings via the products and technologies provided to other industries and consumers. |
